Can you appeal a parking fine in Sweden?
Who to contact, what to pay first and the time limit.
Short answer
Yes, a parking notice from a municipality or the police is contested with the Swedish Police, but you must pay the fee first and it is refunded if you succeed. A private kontrollavgift is contested with the issuer named on it, preferably in writing and as soon as possible.
Why
- Transportstyrelsen says the Swedish Police handle contests of parking notices, through the Police e-service or a form, and that the fee must be paid even if you think it is wrong.
- The Swedish Police say you must have paid before you contest, and the contest must reach the Police within six months after you paid, or after Kronofogden acted to collect.
- Konsumentverket says to contact the issuer of a kontrollavgift as soon as possible, preferably in writing, with photos if you can, and that the issuer must prove its claim.
Details
The Police cannot lower the amount or assess whether it is reasonable, because the municipality sets the fee. For obvious errors in the notice, the Act on felparkeringsavgift (1976:206) lets you apply to the Police for a correction. See parking and fines in Sweden and how to contest a private parking charge.
Tip
Keep the notice, photos of the signs and your payment receipt, and send your contest in writing with the case number and registration number. See also what Stockholm says about minutes over the time.
What may differ
A kontrollavgift is not contested with the Police. In Gothenburg, Parkering Göteborg tells people not to pay its own kontrollavgift before they have objected or received a reply, while a municipal parking notice there must be paid first.
Common misconception
You do not have to pay a municipal parking fine while you are contesting it.
What actually happens
Transportstyrelsen and the City of Stockholm both say the fee must be paid even if you think it is wrong, and the money is refunded if the contest succeeds.
